Terms & conditions

Scope

These terms govern the use of this website and the coaching services provided by The Performance Collective.

Programs and enrollment

Programs last 3, 6 or 12 months. Enrollment is subject to evaluation and availability. The program starts on the day we send you your plan, after the payment is confirmed.

Prices and payment

Prices are in Mexican pesos (MXN) and are the total price of the program. Payment is 100% in advance, as a one-time payment, with no monthly installments, partial payments or recurring charges. You can only pay once your application has been accepted, through a private payment link processed by PayPal. The amount is the price in force when you submitted your application. Your program is confirmed when PayPal confirms the payment. The price shown is the total to pay: no taxes or extra charges are added.

Cancellations, refunds, pauses and rescheduling

The Cancellation and refund policy forms part of these terms and must be accepted separately before paying. In short: when you pay you commit to the whole program; there are no cancellations and no refunds; results are not guaranteed; the program is personal and non-transferable without authorisation; there are no automatic pauses and extraordinary requests are assessed individually. This policy does not limit the non-waivable rights that the law grants to consumers.

Eligibility

The programs are available only to people aged 18 or over; minors are not accepted.

Health, risks and informed consent

Training, changes in eating and competition preparation carry inherent risks. Before the program starts you must accept, separately, the "Informed consent and assumption of risk" document, which describes those risks, your statements about your health, the warning signs that require stopping and seeking medical care, and the separate consents for health data, progress photographs and promotional use of images. Coaching does not replace diagnosis, treatment or care by licensed health professionals.

Limitation of liability

Nothing in these terms excludes or limits liability for wilful misconduct, negligence, breach of law, or your non-waivable rights as a consumer. Within those limits, the Provider is not responsible for damage caused by false or omitted health information, failure to follow safety instructions, activities outside the program or decisions you make on your own outside the contracted services. Details in the "Informed consent and assumption of risk" document.

Electronic acceptance

These terms and the informed consent are accepted electronically with separate, unticked boxes before payment. The version accepted, date and time are recorded. Your rights as a consumer can be exercised before PROFECO (Procuraduría Federal del Consumidor).

Results

Results are not guaranteed: they depend on each person, their starting point and their adherence to the plan.

Governing law

These terms are governed by the federal laws of Mexico. For any dispute, the parties submit to the competent courts of Mexico City, without prejudice to your right to go to PROFECO.
