Informed consent and assumption of risk

Please read this document carefully. You must accept it, separately from the terms and conditions, before your program starts. Your acceptance is recorded with the version of this document, the date and the time.

1. Who provides the service and who may use it

The Lifestyle Coaching and Contest Prep Coaching programs (online or in person in Mexico City) are provided by The Performance Collective ("the Provider"). They are available only to people aged 18 or over who accept this document personally.

2. What coaching is, and what it is not

Coaching consists of training planning, general guidance on eating habits, follow-up and, in Contest Prep, preparation for bodybuilding competitions. - It is NOT medical care: it does not include diagnosis, treatment, prescription or medical follow-up. - It does not replace physiotherapy, psychology or any other health service. If you have, or develop, a health condition, the Provider may ask for a written medical clearance before starting or continuing, and may adapt, pause or end the program for your safety.

3. Your statements and commitments

By accepting, you state and commit that: - The information you give about your relevant health history (illnesses, injuries, surgeries, pregnancy or breastfeeding, and any other relevant condition) is true and complete. - You will report promptly any change that affects your participation (new symptoms, injuries, diagnoses, pregnancy). - You have consulted, or will consult before starting, a physician when you have risk factors or doubts about your fitness for intense exercise or for an eating plan. - You will follow the safety instructions and the agreed limits of the program. False or incomplete information may prevent the program from being adapted safely, and will be taken into account, as provided by law, when determining responsibilities.

4. Warning signs: stop and seek medical care

Stop the activity immediately and seek medical care if you have, among others: - chest pain or pressure, shortness of breath out of proportion to the effort, palpitations or irregular heartbeat; - dizziness, fainting, confusion, severe headache or vision changes; - sudden or intense pain, a "snap" in a muscle or joint, or loss of strength; - dark urine with intense muscle pain or swelling, very high body temperature, or signs of severe dehydration. In an emergency call 911. Then let your coach know, so the program can be paused or adapted.

5. Results are not guaranteed

The Provider commits to providing the service with professional diligence, but does not guarantee specific results in body composition, fat loss, muscle gain, strength, performance, or competition placings, qualifications or professional cards. Results depend on each person, their starting point, genetics, health, adherence, rest and other factors outside the Provider's control.

6. Your decisions outside the service

The Provider is not automatically responsible for decisions you make on your own outside the scope of the contracted services: for example, activities, training, diets, supplements not indicated in your program, ignoring instructions or warning signs, or following advice from third parties. This does not limit the responsibility that corresponds to the Provider by law for its own acts or omissions.

7. Limitation of liability

Nothing in this document or in the terms and conditions excludes or limits the Provider's liability for wilful misconduct, negligence, breach of applicable law, or the rights that the Federal Consumer Protection Law (Ley Federal de Protección al Consumidor) grants you and that cannot be waived. Within those limits, the Provider is liable for the damage proven to be caused by its failure to perform its obligations, and is not liable for damage caused by: false or omitted health information; failure to follow safety instructions or to stop when warning signs appear; activities outside the program; or acts of health professionals or other third parties not engaged by the Provider.

8. Separate consents for your data and images

Each of the following is a separate decision, with its own box, never pre-ticked: - Health data (sensitive personal data): required to design and adapt your program safely. Under the Federal Law on Protection of Personal Data Held by Private Parties, it needs your express written consent, which you give electronically. It is used only for your program and is not shared with third parties except the processors listed in the privacy notice. - Progress photographs: optional. Used only for your private follow-up, visible only to the coaching team, stored securely and deleted when the program ends plus 12 months, or earlier if you ask. - Promotional use of images: optional and independent. The Provider will not publish any image, video or result of yours (on the website, social media or advertising) without this specific consent. You may choose to appear without your face or name. Refusing does not affect your program or its price. You can withdraw any of these consents at any time by sending a WhatsApp message to +52 55 4003 2661. Withdrawing the consent for health data may make it impossible to continue the program safely. Withdrawing promotional consent stops future uses; content already published will be removed within 15 business days where technically possible.

9. Electronic acceptance and record

You accept this document electronically, before payment and before the program starts, by ticking separate boxes that are never pre-ticked. The system records which boxes you accepted, the version of each document, the date and time, and the reference of your application and payment. The record cannot be edited. You can ask for a copy of what you accepted at any time.
